Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a binding agreement between you ("User", "you") and Roas Labs SpA, operator of Transcapt ("Transcapt", "we", "us"). By creating an account, purchasing credits, or using the service at transcapt.com, you confirm that you have read, understood, and accepted these Terms in full. If you do not agree, do not use the service.

We may update these Terms from time to time. Material changes will be notified by email and by a banner on the site at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

2. Service Description

Transcapt provides an online speech-to-text service powered by third-party AI models, including OpenAI Whisper. Users upload audio or video files (or provide a public YouTube URL) and receive a text transcript in multiple formats (TXT, SRT, DOCX, PDF).

Accuracy depends on audio quality, language, accents, and background noise. Transcapt makes no guarantee of 100% accuracy. Output should be reviewed by the user before relying on it in legal, medical, or other high-stakes contexts.

3. Account Registration

You must be at least 16 years old to create an account. You agree to provide accurate, current, and complete information, and to keep it up to date. You are responsible for all activity that occurs under your account and for keeping your credentials secure. Notify us immediately at [email protected] if you suspect unauthorised access.

4. Credits and Pay-Per-Use Pricing

Transcapt operates on a pay-per-use basis. There are no recurring subscriptions. Users purchase credit packs (for example, 1 hour, 5 hours, or 10 hours of transcription) that are deducted as minutes are processed. New accounts receive 15 free minutes on signup. YouTube caption extraction is offered free of charge and does not consume credits.

Credits do not expire as long as your account remains active. Unused credits are non-transferable between accounts. Refunds are governed by our separate Refund Policy.

5. Acceptable Use

You warrant that you own, or have all necessary rights, licences, and consents to, any audio or video you upload. You may not use Transcapt to process content that is unlawful, defamatory, or that infringes intellectual-property, privacy, or publicity rights of any third party.

The following are prohibited: (a) reverse engineering or scraping the service; (b) attempting to circumvent rate limits, credit counters, or security measures; (c) uploading malware or content containing personal data of third parties without a lawful basis; (d) using the service to produce content that violates applicable laws in your jurisdiction.

We may suspend or terminate accounts that violate these rules and, where required, report illegal content to competent authorities.

6. User Content Licence

You retain all ownership of the audio, video, and transcripts associated with your account ("User Content"). You grant Transcapt a narrow, worldwide, royalty-free licence to host, process, store, and display your User Content solely to operate the service for you: uploading, transcribing, generating downloadable files, and retaining the results in your account until you delete them.

We do not use your User Content to train AI models. Sub-processors may process it only to perform the task you requested (see Section 7).

7. Third-Party Services

Transcapt relies on the following sub-processors to deliver the service:

  • OpenAI (Whisper API) — speech-to-text processing
  • Supabase — authentication, database, and file storage
  • Lemon Squeezy — global payment processing (credit card, PayPal)
  • MercadoPago — payments for Latin American users
  • Resend — transactional email delivery
  • PostHog — product analytics (consent-gated)
  • Hostinger — application hosting (VPS)
  • Cloudflare — content delivery and DDoS protection

8. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. Transcapt does not warrant that the service will be uninterrupted, error-free, secure, or that transcription output will be accurate or complete.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Transcapt, its directors, employees, and sub-processors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service.

Our total aggregate liability for any claim arising out of or relating to these Terms or the service shall not exceed the greater of (a) the total amount you paid to Transcapt in the 12 months preceding the claim, or (b) EUR 100. Nothing in these Terms excludes liability for gross negligence, wilful misconduct, or any liability that cannot be limited by law.

10. Termination

You may close your account at any time from the dashboard or by emailing [email protected]. We may suspend or terminate your account if you materially breach these Terms, if required by law, or if continued provision becomes commercially unviable (with 30 days' notice in the latter case).

Upon termination, access to your User Content ends. Data retention after termination is governed by our Privacy Policy.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Chile, without regard to its conflict-of-laws rules. The competent courts of Santiago, Chile, shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, subject to any mandatory consumer-protection rights you may have in your country of residence.
